In response to a letter from Senator Edward Markey, GAO issued a legal opinion regarding the application of the Congressional Review Act (CRA) to a memorandum issued by the Attorney General on April 6, 2018, which directed each U.S. Attorney's Office along the southwest border to adopt immediately a zero-tolerance policy for prosecution of certain immigration offenses. The policy would supersede any existing policies. We concluded that DOJ's memorandum is not subject to the CRA because it is a rule of agency procedure or practice. The rights or obligations in question are prescribed by existing immigration laws and remain unchanged by the agency's procedures at issue here.
