[Protests of Navy Cancellation of Solicitations for Material Handling and Logistics Support Services]

Highlights

A firm protested the Navy's cancellation of two solicitations for material handling and logistics support services and the sole-source extensions of two contracts for those services, contending that: (1) there was no rational basis for the cancellations or the sole-source extensions; and (2) the Navy's actions resulted from the lack of advance planning. GAO held that the Navy: (1) reasonably cancelled the solicitations, since it substantially revised the statements of work and source selection criteria due to fundamental flaws in the solicitation specifications; and (2) created the need for the sole-source extensions of the incumbent's contracts by its failure to engage in advance planning. Accordingly, the protests were sustained, and GAO recommended that the Navy: (1) expeditiously finalize competitive procurements for these requirements and terminate the incumbent's contracts upon award of those contracts; and (2) reimburse the protester for its protest costs.
