Highlights

A firm protested an Army Corps of Engineers contract award for site remediation, contending that the: (1) awardee's bid did not represent the best value to the government; (2) awardee received preferential treatment; and (3) Army failed to conduct meaningful discussions. GAO held that the protest was academic, since the: (1) Army intended to reevaluate the technical proposals; and (2) protester merely anticipated improper agency action. Accordingly, the protest was dismissed.
