[Protest of FAA Rejection of Bid for Air Traffic Control Services]
Highlights
A firm protested the Federal Aviation Administration's (FAA) rejection of its bid for air traffic control services, contending that FAA: (1) improperly evaluated its technical proposal; and (2) limited its ability to compete for award when it failed to hold adequate discussions regarding its apparent bid deficiencies. GAO held that FAA: (1) properly evaluated the protester's bid in accordance with the solicitation's evaluation criteria; (2) reasonably rejected the protester's bid as technically unacceptable, since the protester failed to submit required information demonstrating its responsiveness; and (3) properly notified the protester of its bid deficiencies and provided it a reasonable opportunity to correct them. Accordingly, the protest was denied.
