Backpay for Medical Disqualification for Air Traffic Controller

Highlights

An air-traffic controller claimed certain premium pay and differentials lost as a result of his involuntary temporary assignment for medical reasons from air traffic-control duties to administrative duties. The Federal Aviation Administration's Board of Review concluded that the medical evidence did not support the finding of medical disqualification. The employee was entitled to the premium pay which he would have earned had he not been reassigned.
