A former employee claimed reimbursement of legal fees incurred in his defense against a lawsuit filed by his supervisor for libel and malicious defamation for allegations contained in letters which the employee wrote to public officials. The claim was not allowed because there was no determination that the employee's acts were within the scope of official duties or in the interest of the United States.
