GAO reviewed the Department of Health and Human Services, Centers for Medicare and Medicaid Services' (CMS) new rule on negotiated pricing and remaining revisions for Medicare Advantage and Prescription Drug Benefit Programs. GAO found that (1) the rule revises the regulations governing the Medicare Advantage program (Part C) and prescription drug benefit program (Part D). The final rule also includes provisions regarding medical savings account plans, cost-sharing for dual eligible enrollees enrolled in the Medicare Advantage program, the prescription drug payment and novation processes in the Part D program, and the enrollment and appeals processes for both programs; and (2) CMS complied with applicable requirements in promulgating the rule.
