GAO reviewed the Department of Health and Human Services, Centers for Medicare and Medicaid Services' (CMS) new rule on several prospective payment systems and rates, graduate medical education payments at affiliated teaching hospitals, and provider designations for critical access hospitals. GAO found that (1) the final rule revises the protective payments systems, includes changes made to the 2008 hospital inpatient provider payment system, and modifies the regulations relating to graduate medical education payments made to teaching hospitals that have Medicare affiliation agreements for certain emergency situations; and (2) with the exception to the delay in the rule's effective date, CMS complied with the applicable requirements.
