GAO reviewed the Department of Health and Human Services, Centers for Medicare and Medicaid's (CMS) new rule on the competitive acquisition of medical equipment, prosthetics, orthotics, and supplies (DMEPOS), accreditation of DMEPOS supplies, and the prospective payment system. GAO found that (1) the rule updates the prospective payment rates for inpatient rehabilitation facilities for fiscal year 2007, establishes certain requirements related to competetive acquisition for durable medical equipment, prosthetics, orthotics, and supplies, and establishes accreditation of suppliers as required under section 302 of the Medicare Prescription Drug, Improvement, and Management Act of 2003; and (2) CMS complied with the applicable requirements in promulgating the rule, with the exception of the delay in the rule's effective date.
