GAO reviewed the Department of Health and Human Services, Centers for Medicare and Medicaid Services' (CMS) new rule on the Medicare Prescription Drug Benefit. GAO found that (1) the rule would implement the provisions of the Social Security Act added by the Medicare Prescription Drug, Improvement, and Modernization Act of 2003 establishing the new voluntary prescription drug benefit program, and (2) with the exception of the 60-day delay in the rule's effective date, CMS complied with all applicable requirements in promulgating the rule.
