[Request for Waiver of Erroneous Payments]

A retired Army officer requested reconsideration of his denied waiver for indebtness due to erroneous retired pay payments he received after he accepted civilian employment, contending that he was not aware of the overpayment, since there had been: (1) numerous explained and unexplained fluctuations in his retired pay; (2) an ever changing array of payments, apparent underpayments, and alleged overpayments; and (3) numerous salary and cost of living changes. GAO held that the claimant: (1) attempted to ensure the accuracy of his retired pay during his civilian employment; and (2) was without fault, and could not reasonably be expected to recognize that he was being overpaid. Accordingly, waiver was granted.
