In response to a congressional request, GAO reconsidered its opinion that an alternative plan to the Orme Dam required reauthorization. GAO had originally held that, although the plan was not a suitable alternative to Orme Dam, Congress appropriated additional funds and there was no legal basis for objecting to the Department of the Interior's implementation of the plan. Upon further review, GAO examined the plan's legislative history and found that it did not indicate clear congressional intent to provide the additional funding necessary for construction. Therefore, GAO believes that the Department of the Interior should obtain congressional authorization for the plan prior to construction.
