Pursuant to a congressional request, GAO discussed whether exchange agreements between the Patent and Trademark Office (PTO) and private firms, to automate PTO trademark search activities, are subject to the Brooks Act. GAO held that these exchange agreements for products and services are essentially procurement contracts and that they are, therefore, subject to the act.
