GAO reviewed a proposed new section which would be added to Title 5 of the the U.S. Code. Relevant provisions of this proposed section, which specifically require the Comptroller General to assume continuing review of agency rulemaking and regulatory analyses, were compared with the existing GAO authority. The new provisions are not necessary to carry out the reviews and analyses required by the proposed legislation. The Comptroller General could conduct the necessary studies and report to Congress on agency rulemaking proceedings under the authority of the Legislative Reorganization Act of 1970.
